Per\u00f2 <strong>qu\u00e8 passa amb les empreses m\u00e9s petites?<\/strong> No corren risc de caure en situacions de discriminaci\u00f3 per ra\u00f3 de g\u00e8nere?<\/p>\n<p>Per descomptat que <strong>a totes les empreses, tamb\u00e9 les m\u00e9s petites, hi ha risc d&#8217;assetjament laboral,<\/strong> per\u00f2 per altra banda, aprovar uns Plans d&#8217;Igualtat pot ser un proc\u00e9s llarg i complex, perqu\u00e8 consta de diverses fases i cal negociar-los amb una representaci\u00f3 legal dels treballadors, per la qual cosa, en concret per a les pimes, podria ser, a m\u00e9s, molt cost\u00f3s econ\u00f2micament.<\/p>\n<p>Per tant, per normativa les empreses de menys de 50 treballadors estan obligades a <strong>tenir nom\u00e9s algunes parts dels Plans d&#8217;Igualtat,<\/strong> que s\u00f3n l&#8217;auditoria salarial (de la qual ja n&#8217;hem parlat anteriorment <a href=\"https:\/\/edorteam.com\/ca\/el-registre-salarial-ja-es-obligatori-per-a-totes-les-empreses\/\">en aquesta publicaci\u00f3<\/a>) i el protocol per a la prevenci\u00f3 de l&#8217;assetjament sexual laboral, que \u00e9s el tema que ens ocupa avui.<\/p>\n<p>&nbsp;<\/p>\n<h2>El Protocol per a la prevenci\u00f3 de l&#8217;assetjament sexual laboral \u00e9s obligatori per a totes les empreses<\/h2>\n<p>El Protocol d&#8217;Assetjament Laboral i Assetjament Sexual i Assetjament per Ra\u00f3 de Sexe \u00e9s obligatori per a totes les empreses independentment del nombre de treballadors, aix\u00f2 tamb\u00e9 s&#8217;aplica a aut\u00f2noms amb treballadors al seu c\u00e0rrec. El seu objectiu \u00e9s <strong>assegurar un clima positiu i saludable per a totes les persones<\/strong> que formen part de l&#8217;empresa, i requereix el comprom\u00eds de la direcci\u00f3 i de tot l&#8217;equip professional.<\/p>\n<p>Inspecci\u00f3 de Treball ja est\u00e0 fent inspeccions per comprovar que les empreses compten amb un protocol que compleixi amb la normativa, <strong><a href=\"#contacto\">contacta ara amb nosaltres<\/a><\/strong> per complir de forma r\u00e0pida i efica\u00e7 amb aquesta nova obligaci\u00f3 per a les empreses.<\/p>\n<p>Aquest protocol estableix la necessitat d&#8217;elaborar i difondre codis de bones pr\u00e0ctiques, campanyes informatives i accions de formaci\u00f3 als seus treballadors i treballadores. A continuaci\u00f3 et detallem les diferents fases del proc\u00e9s:<\/p>\n<ol>\n<li>Designar un comit\u00e8 assessor.<\/li>\n<li>Elaborar la normativa interna i definir el conjunt de mesures preventives.<\/li>\n<li>Descriure el procediment per denunciar els comportaments que suposin assetjament sexual laboral.<\/li>\n<li>Determinar quines proves s\u00f3n v\u00e0lides per demostrar l&#8217;assetjament sexual laboral.<\/li>\n<li>Definir les sancions aplicables.<\/li>\n<li>Elaborar el protocol i divulgar-lo a l&#8217;equip professional.<\/li>\n<\/ol>\n<p>El Protocol per a la prevenci\u00f3 de l&#8217;assetjament sexual laboral s&#8217;ha de fer d&#8217;acord amb l&#8217;article 48 de la Llei org\u00e0nica 3\/2007, de 22 de mar\u00e7, per a la igualtat efectiva de dones i homes i la seva obligatorietat es regeix pel Reial decret 901\/2020, de 13 d&#8217;octubre, pel qual es regulen els plans d&#8217;igualtat i el seu registre i es modifica el Reial decret 713\/2010, de 28 de maig, sobre registre i dip\u00f2sit de convenis i acords col\u00b7lectius de treball, aix\u00ed com amb l&#8217;article 14 de la Llei 31\/1995, del 8 de novembre, de prevenci\u00f3 de riscos laborals.<\/p>\n<p>&nbsp;<\/p>\n<h2>Adapta&#8217;t a la nova normativa de forma f\u00e0cil i r\u00e0pida amb Edorteam<\/h2>\n<p>A Edorteam farem el <strong>protocol d&#8217;assetjament laboral obligatori per a la vostra empresa<\/strong> adaptat a les vostres necessitats i naturalesa, sense que suposi temps de dedicaci\u00f3 per a la direcci\u00f3 ni es dispari la inversi\u00f3 necess\u00e0ria.
