passat, una <a href=\"https:\/\/www.aepd.es\/es\/documento\/ps-00262-2021.pdf\" target=\"_blank\" rel=\"noopener\">resoluci\u00f3 de procediment sancionador<\/a> de 30.000\u20ac a CEDICO (Centre de Diagn\u00f2stic per la Imatge) per compartir la hist\u00f2ria cl\u00ednica.<\/p>\n<p>Un pacient va interposar una reclamaci\u00f3 a l&#8217;AEPD on explicava que <strong>la seva M\u00fatua laboral li havia denegat una baixa per accident laboral<\/strong> el novembre del 2020 perqu\u00e8 la M\u00fatua havia tingut acc\u00e9s a una resson\u00e0ncia magn\u00e8tica realitzada el juliol del 2020 i van comprovar que la lesi\u00f3 ja existia anteriorment a l&#8217;accident.<\/p>\n<p>En concret explica: &#8220;me dirijo a mi Mutua laboral por accidente laboral <strong>encontrando mi informe privado en tal despacho<\/strong> y vulnerando mi privacidad&#8221;.<\/p>\n<div id=\"ez-toc-container\" class=\"ez-toc-v2_0_81 ez-toc-wrap-left-text counter-hierarchy ez-toc-counter ez-toc-custom individual a CEDICO<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>La part reclamant explica que aquesta resson\u00e0ncia se la va fer de forma privada i individual a CEDICO, i que la seva confidencialitat s&#8217;ha vulnerat en<strong>compartir informaci\u00f3 de la seva hist\u00f2ria cl\u00ednica amb un tercer<\/strong> (i empresa privada), \u00e9s a dir, la M\u00fatua laboral.<\/p>\n<p>Malgrat que el centre de diagn\u00f2stic per la imatge va defensar davant l&#8217;AEPD d&#8217;accedir a la hist\u00f2ria cl\u00ednica \u00e9s necessari per a \u201cfacilitar asistencia sanitaria, dejando constancia de todos aquellos datos que bajo criterio m\u00e9dico permitan el conocimiento veraz y actualizado del estado de salud\u201d i que \u201cen ning\u00fan caso se le comunican ni informes ni ning\u00fan otro tipo de informaci\u00f3n cl\u00ednica distinta a la solicitada\u201d, <strong>el cas s&#8217;ha resolt a favor de la part reclamant.<\/strong><\/p>\n<p>L&#8217;AEPD va iniciar un procediment sancionador a CEDICO per la presumpta infracci\u00f3 de l&#8217;article 5.1.f) de l&#8217;RGPD, en relaci\u00f3 amb l&#8217;article 5 de la LOPDGDD, conforme assenyala l&#8217;article 83.5 a) de l&#8217;RGPD i el 72.1.a) de la LOPDGDD. Finalment, l&#8217;empresa denunciada <strong>ha optat pel pagament voluntari<\/strong> per aplicar les reduccions corresponents, amb el que la sanci\u00f3 ha estat finalment de 18.000 \u20ac.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"La_mutua_pot_tenir_acces_al_meu_historial_medic\"><\/span>La m\u00fatua pot tenir acc\u00e9s al meu historial m\u00e8dic?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>En principi, una M\u00fatua laboral no t\u00e9 dret a accedir a la teva hist\u00f2ria cl\u00ednica sense el teu consentiment expl\u00edcit. La legislaci\u00f3 en mat\u00e8ria de protecci\u00f3 de dades personals i espec\u00edficament, les dades de salut, \u00e9s molt estricta en aquest aspecte. Les dades de salut s\u00f3n considerades categories especials de dades personals i el seu tractament est\u00e0 subjecte a condicions particulars, nom\u00e9s poden ser accedides quan l&#8217;interessat doni el seu consentiment expl\u00edcit.<\/p>\n<p><strong>Hi ha per\u00f2, excepcions<\/strong>. Per exemple, en el cas de processos d&#8217;incapacitat laboral on la M\u00fatua necessita informaci\u00f3 per avaluar la situaci\u00f3 del treballador. Fins i tot en aquest cas, no cal proporcionar una c\u00f2pia completa de la hist\u00f2ria cl\u00ednica, sin\u00f3 nom\u00e9s els informes m\u00e8dics relacionats amb la incapacitat. Aquesta informaci\u00f3 \u00e9s necess\u00e0ria perqu\u00e8 la M\u00fatua pugui prendre decisions sobre l&#8217;alta o la baixa del treballador.<\/p>\n<p>A m\u00e9s, cal tenir en compte que l&#8217;acc\u00e9s a aquestes dades per part de la M\u00fatua s&#8217;ha de fer sempre respectant els principis de limitaci\u00f3 de la finalitat i minimitzaci\u00f3 de dades previstes a la normativa de protecci\u00f3 de dades. Aix\u00f2 significa que nom\u00e9s es poden utilitzar per a la finalitat que en va justificar l&#8217;obtenci\u00f3 i no es poden recollir m\u00e9s dades de les estrictament necess\u00e0ries per a aquesta finalitat.<\/p>\n<p>En resum, encara que hi ha situacions en qu\u00e8 la M\u00fatua pot tenir acc\u00e9s a determinades dades de salut del treballador, no pot accedir a la hist\u00f2ria cl\u00ednica completa sense el consentiment del pacient. La violaci\u00f3 d&#8217;aquestes normes pot donar lloc a <strong>sancions molt elevades<\/strong> , com l&#8217;esmentada al t\u00edtol d&#8217;aquest article.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Puc_demanar_copia_dinformes_medics_a_la_mutua\"><\/span>Puc demanar c\u00f2pia d&#8217;informes m\u00e8dics a la m\u00fatua<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>En efecte, tot pacient t\u00e9 el dret de sol\u00b7licitar una c\u00f2pia dels seus informes m\u00e8dics a la m\u00fatua laboral. Aquest dret est\u00e0 protegit per la Llei dAutonomia del Pacient, que estableix que els pacients tenen dret a accedir a tota la documentaci\u00f3 de la seva hist\u00f2ria cl\u00ednica. No obstant aix\u00f2, \u00e9s important tenir en compte que la m\u00fatua pot trigar un temps a processar la sol\u00b7licitud i proporcionar els informes.<\/p>\n<p><strong>Per sol\u00b7licitar c\u00f2pia dels informes m\u00e8dics a la m\u00fatua<\/strong> , podeu adre\u00e7ar-vos a l&#8217;entitat i fer la sol\u00b7licitud per escrit. A la sol\u00b7licitud, haur\u00e0s d&#8217;indicar les teves dades personals, la informaci\u00f3 que vols obtenir i un domicili per rebre la informaci\u00f3. A m\u00e9s, \u00e9s recomanable adjuntar una c\u00f2pia del DNI per verificar la teva identitat.<\/p>\n<p>En algunes ocasions, la m\u00fatua es pot negar a proporcionar els informes m\u00e8dics. En aquests casos, pots rec\u00f3rrer a l&#8217;Ag\u00e8ncia Espanyola de Protecci\u00f3 de Dades perqu\u00e8 hi intervingui. Aquesta entitat t\u00e9 la potestat de requerir la m\u00fatua que et proporcioni els informes m\u00e8dics.<\/p>\n<p>Finalment, \u00e9s important recordar que <strong>la hist\u00f2ria cl\u00ednica \u00e9s confidencial<\/strong>. Nom\u00e9s tu, com a pacient, tens dret a accedir-hi i autoritzar-ne la divulgaci\u00f3. Cap tercer no pot accedir a la teva hist\u00f2ria cl\u00ednica sense el teu consentiment expl\u00edcit, llevat que hi hagi una ordre judicial que ho autoritzi.<\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row column_structure=&#8221;1_2,1_2&#8243; _builder_version=&#8221;4.24.1&#8243; _module_preset=&#8221;default&#8221; width=&#8221;100%&#8221; global_colors_info=&#8221;{}&#8221;][et_pb_column type=&#8221;1_2&#8243; _builder_version=&#8221;4.24.1&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;][et_pb_image src=&#8221;https:\/\/edorteam.com\/wp-content\/uploads\/acompanamiento-proceso-aborto-min-1.jpg&#8221; alt=&#8221;compartir la hist\u00f2ria cl\u00ednica&#8221; title_text=&#8221;compartir la hist\u00f2ria cl\u00ednica&#8221; _builder_version=&#8221;4.24.1&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;][\/et_pb_image][\/et_pb_column][et_pb_column type=&#8221;1_2&#8243; _builder_version=&#8221;4.24.1&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;][et_pb_text _builder_version=&#8221;4.24.1&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Estic_obligat_a_lliurar_informes_medics_a_la_mutua\"><\/span>Estic obligat a lliurar informes m\u00e8dics a la m\u00fatua<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>L&#8217;obligaci\u00f3 de lliurar informes m\u00e8dics a la m\u00fatua \u00e9s un tema que genera certes controv\u00e8rsies. \u00c9s important destacar que <strong>el pacient t\u00e9 el dret a la privadesa de les seves dades m\u00e8diques<\/strong>, per la qual cosa qualsevol intercanvi d&#8217;informaci\u00f3 requerir\u00e0 el seu consentiment previ.<\/p>\n<p>\u00c9s com\u00fa que les m\u00fatues sol\u00b7licitin informes m\u00e8dics per avaluar les capacitats del treballador i determinar si es pot reincorporar al seu lloc de treball. No obstant aix\u00f2, <strong>el metge no est\u00e0 obligat a proporcionar aquests informes a la m\u00fatua sense el consentiment del pacient.<\/strong> La llei protegeix la confidencialitat de la informaci\u00f3 m\u00e8dica i exigeix \u200b\u200bque es respecti.<\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row _builder_version=&#8221;4.24.1&#8243; _module_preset=&#8221;default&#8221; width=&#8221;100%&#8221; global_colors_info=&#8221;{}&#8221;][et_pb_column type=&#8221;4_4&#8243; _builder_version=&#8221;4.24.1&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;][et_pb_text _builder_version=&#8221;4.24.1&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p>Hi ha excepcions a aquesta norma en casos en qu\u00e8 estigui en joc la salut p\u00fablica o la seguretat del pacient o de tercers. En aquestes situacions, <strong>la llei permet lintercanvi dinformaci\u00f3 m\u00e8dica sense el consentiment del pacient<\/strong> , per\u00f2 aquestes excepcions s\u00f3n limitades i han de ser justificades.<\/p>\n<p>Una sanci\u00f3 de 30.000\u20ac per compartir la hist\u00f2ria cl\u00ednica d&#8217;un pacient amb la seva M\u00fatua laboral \u00e9s una mostra de la import\u00e0ncia que se li d\u00f3na a la privadesa i la confidencialitat en l&#8217;\u00e0mbit sanitari. Aquest cas \u00e9s un recordatori que <strong>la infracci\u00f3 de la privadesa del pacient pot comportar greus conseq\u00fc\u00e8ncies legals.<\/strong><\/p>\n<p>En conclusi\u00f3, encara que les m\u00fatues poden sol\u00b7licitar informes m\u00e8dics, els professionals sanitaris no estan obligats a lliurar-los sense el consentiment del pacient. <strong>La privadesa i la confidencialitat s\u00f3n drets fonamentals del pacient<\/strong> i han de ser respectats en tot moment.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"La_mutua_et_pot_demanar_informes_medics\"><\/span>La m\u00fatua et pot demanar informes m\u00e8dics<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>A nivell laboral, \u00e9s com\u00fa que les m\u00fatues col\u00b7laborin en el seguiment de malalties o lesions dels treballadors. En aquest context, <strong>la m\u00fatua pot sol\u00b7licitar informes m\u00e8dics<\/strong> per avaluar l&#8217;estat de salut del treballador i determinar si pot tornar al lloc de treball o si requereix algun tipus d&#8217;adaptaci\u00f3 laboral.<\/p>\n<p>\u00c9s important ressaltar que <strong>el dret a la intimitat del pacient<\/strong> \u00e9s primordial. La m\u00fatua nom\u00e9s pot accedir a la informaci\u00f3 m\u00e8dica del treballador si aquest d\u00f3na el seu consentiment expl\u00edcit. En cap cas no es pot compartir la hist\u00f2ria cl\u00ednica d&#8217;un pacient sense la seva autoritzaci\u00f3, ja que aix\u00f2 constituiria una violaci\u00f3 de la Llei de protecci\u00f3 de dades.<\/p>\n<p>A m\u00e9s, la informaci\u00f3 que pot sol\u00b7licitar la m\u00fatua ha d&#8217;estar <strong>estrictament relacionada amb la incapacitat laboral<\/strong> que presenta el treballador. No es poden requerir detalls sobre altres condicions de salut que no tinguin relaci\u00f3 directa amb la incapacitat del treballador i la possible reincorporaci\u00f3 a la feina.<\/p>\n<p>En cas que es requereixi compartir informaci\u00f3 m\u00e8dica amb la m\u00fatua, \u00e9s essencial que es faci <strong>de manera segura i confidencial<\/strong> , garantint en tot moment el respecte als drets del pacient. Qualsevol violaci\u00f3 d&#8217;aquestes normes pot comportar sancions significatives, com ara multes econ\u00f2miques o fins i tot conseq\u00fc\u00e8ncies penals.<\/p>\n<p>En resum, encara que les m\u00fatues poden sol\u00b7licitar informes m\u00e8dics en el context laboral, <strong>\u00e9s fonamental respectar els drets del pacient<\/strong> i seguir les normes de protecci\u00f3 de dades. L&#8217;incompliment d\u201faquestes normes pot resultar en sancions greus, com s\u201fevidencia en el cas de la sanci\u00f3 de 30.000\u20ac per compartir la hist\u00f2ria cl\u00ednica d&#8217;un pacient amb la seva M\u00fatua laboral.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"La_mutua_te_acces_al_teu_historial_medic\"><\/span>La m\u00fatua t\u00e9 acc\u00e9s al teu historial m\u00e8dic<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>La relaci\u00f3 entre un pacient i la seva M\u00fatua laboral \u00e9s complexa i plena de matisos. Una de les q\u00fcestions m\u00e9s delicades \u00e9s fins a quin punt, <strong>la m\u00fatua t\u00e9 acc\u00e9s al teu historial m\u00e8dic<\/strong>. L&#8217;acc\u00e9s a la hist\u00f2ria cl\u00ednica \u00e9s un tema delicat, ja que es tracta d&#8217;informaci\u00f3 personal sensible i protegida per lleis de privadesa i protecci\u00f3 de dades.<\/p>\n<p>Per defecte, <strong>la m\u00fatua laboral no t\u00e9 acc\u00e9s autom\u00e0tic<\/strong> a la hist\u00f2ria cl\u00ednica dels associats. L&#8217;acc\u00e9s a la informaci\u00f3 m\u00e8dica requereix el consentiment expl\u00edcit del pacient. Aquest consentiment pot \u00e9sser revocat en qualsevol moment, i la seva violaci\u00f3 pot portar a sancions significatives com es pot veure en el cas que motiva aquest article.<\/p>\n<p>\u00c9s important destacar que, malgrat que les m\u00fatues laborals poden sol\u00b7licitar l&#8217;acc\u00e9s a la hist\u00f2ria cl\u00ednica, <strong>el pacient no est\u00e0 obligat a proporcionar-la<\/strong>. Hi pot haver casos en qu\u00e8 la m\u00fatua sol\u00b7liciti aquesta informaci\u00f3 per avaluar si una malaltia o lesi\u00f3 \u00e9s laboral o no.
